The most important rule in daily road traffic is mutual consideration. More vulnerable road users, such as pedestrians and cyclists, enjoy special protection. Nevertheless, accidents involving cyclists occur time and again on German roads. The reasons for this are manifold, but it is not uncommon for drivers to fail to maintain minimum distances when overtaking. The rules for overtaking were tightened again in 2020 and should definitely be observed by drivers.
New minimum distance when overtaking cyclists
Since May 2020, a minimum distance of 1.5 meters has applied when overtaking cyclists. This applies both when a cyclist is on the road and when they are riding on a cycle path. At higher speeds, the distance should also be increased, as an accident at high speed would have more serious consequences. Outside of built-up areas, a distance of at least 2 meters therefore applies when overtaking cyclists.
Dooring and the "Dutch Reach"
However, the distance requirement applies not only when driving a vehicle, but also to the riders of the two-wheeler. To avoid accidents, cyclists are obliged to ride more in the middle of the lane. On closer inspection, this makes perfect sense: uneven road edges as well as protruding or lowered manhole covers can quickly lead to a fall and thus to a collision with a following car. In addition, the lateral distance serves to prevent the phenomenon of "dooring". This refers to accidents in which cyclists are involuntarily slowed down by a suddenly opened driver's door. Therefore, when getting out of the car, the so-called "Dutch Reach" is recommended, in which the door is opened with the right hand instead of the left.
If the distance cannot be maintained
Especially in urban traffic, situations quickly arise in which the lateral distance to the cyclist cannot be maintained. In this case, you must not overtake until it is possible at a suitable location to maintain the prescribed 1.5 meters. Failure to comply can result in a fine of 70 euros and one point in Flensburg. In return, as an affected cyclist, you must of course also adhere to the safety distance.
